Terms and Conditions of Use

1. Acceptance of terms

This document establishes the terms and conditions governing the use of the pantherforensic.com website (hereinafter "the Site"), operated by Tecnología Panther, S.A. de C.V. (hereinafter "Panther Forensic", "the company" or "we"), with address at Avenida Constitución 2050, Colonia Obispado, Monterrey, Nuevo León, C.P. 64060, Mexico.

By accessing, browsing, or using the Site, you (hereinafter "the User") declare to have read, understood, and fully accepted these Terms and Conditions, as well as our Privacy Notice. If you do not agree with any of the terms established here, you must refrain from using the Site.

2. Purpose of the Site

The purpose of the Site is to provide institutional information about Panther Forensic, its products, capabilities, and services, as well as to facilitate initial contact with institutional prospects interested in its technology platforms (IdenticoreADN, VerumLIMS, and other products the company may add).

The Site does not constitute a binding offer of products or services. The effective contracting of any Panther Forensic solution is governed by specific commercial contracts negotiated independently with each institutional client.

3. Site users

The Site is primarily intended for professionals and representatives of public and private institutions related to justice prosecution, forensic laboratories, public security agencies, academic institutions, and sector technologists.

The User declares to have sufficient legal capacity to accept these terms. When acting on behalf of an institution, the User declares to have sufficient authority to bind it.

4. Intellectual property

All Site content — including without limitation: texts, graphics, designs, source code, compiled code, logos, trademarks, trade names, images, videos, audio, illustrations, schemes, diagrams, screenshots, and downloadable materials — is the exclusive property of Panther Forensic or is used under valid license from its respective owners, and is protected by Mexican and international intellectual property laws.

Specifically, the names and brands Panther Forensic, IdenticoreADN, VerumLIMS, as well as their logos, visual identities, and distinctive elements, are property of Panther Forensic. Their unauthorized use constitutes a violation of industrial property rights.

4.1 Limited use license

Panther Forensic grants the User a limited, non-exclusive, non-transferable, revocable, and free license to access and use the Site for legitimate informational purposes, subject to compliance with these Terms. This license does not include:

  • Reproducing, distributing, modifying, or creating derivative works of Site content without written authorization
  • Using data mining techniques, robots, or similar tools for massive information extraction
  • Using content for training artificial intelligence models without express permission
  • Reverse engineering or decompiling Site elements
  • Removing copyright notices, trademarks, or other property indicators
  • Using content for unauthorized commercial purposes

5. Acceptable Site use

The User undertakes to:

  • Use the Site in accordance with the law, morality, good customs, and public order
  • Provide truthful and updated information when using the contact form or other channels
  • Not interfere with normal Site operation or the experience of other users
  • Not introduce viruses, malware, trojans, ransomware, or malicious code of any kind
  • Not attempt to access restricted areas, other users' accounts, or internal systems
  • Not perform vulnerability testing, automated scans, or penetration attempts without written authorization
  • Not impersonate third parties

Panther Forensic reserves the right to block access, report to competent authorities, or take legal action against any User who violates these terms.

6. Informational nature of content

The information published on the Site is for informational purposes only. It does not constitute technical, legal, expert advice, or operational recommendation of any nature. The features, capabilities, and specifications of the products mentioned may vary depending on the contracted configuration, the installed version, and the specific needs of each client.

Panther Forensic reserves the right to modify, update, suspend, or discontinue any content, functionality, or section of the Site at any time, without prior notice. Product descriptions are subject to evolution according to product development.

7. Products and services

The acquisition and use of products and services offered by Panther Forensic (IdenticoreADN, VerumLIMS, and other solutions) are governed by specific contracts entered into separately between Panther Forensic and each institutional client. Those contracts contain the applicable clauses regarding:

  • Functional scope of the delivered product
  • Licensing and intellectual property terms
  • Service levels (SLA) and technical support
  • Warranties, liability limitations, and exclusions
  • Confidentiality and data protection
  • Terms, consideration, and payment method
  • Termination causes
  • Dispute resolution mechanisms

Nothing contained on the Site should be interpreted as substitution, complement, or modification of the clauses agreed upon in such contracts.

8. Limitation of liability

The User acknowledges and accepts that use of the Site is made at their own and exclusive responsibility. To the maximum extent permitted by applicable law, Panther Forensic will not be liable for:

  • Operational, commercial, or any other decisions the User makes based on Site information
  • Direct, indirect, incidental, special, or consequential damages arising from use or inability to use the Site
  • Typographical errors, omissions, outdated data, or inaccuracies in content
  • Service interruptions caused by technical failures, maintenance, cyberattacks, or force majeure events
  • The content, accuracy, or availability of third-party websites linked from the Site
  • The improper use of content by third parties

This liability limitation applies regarding the Site. Liabilities arising from the provision of contracted services are governed by the corresponding specific contracts.

The Site may contain links to websites operated by third parties (e.g., academic resources, international regulations, forensic bodies, or service providers). These links are provided solely for User convenience and do not imply endorsement, recommendation, or relationship with such third parties.

Panther Forensic does not control the content, privacy policies, or practices of those sites and assumes no liability for them. Access to third-party sites is at the User's exclusive risk and responsibility.

10. Personal data and privacy

The processing of personal data collected through the Site is governed by Panther Forensic's Privacy Notice, which forms an integral part of these terms.

11. Information security

Panther Forensic implements reasonable security measures aligned with the guidelines of the ISO/IEC 27001 standard to protect the integrity and confidentiality of information transmitted through the Site. However, no electronic communication or storage system can be guaranteed as completely secure against all possible threats.

The User is responsible for maintaining the confidentiality of any credentials, identifiers, or sensitive information provided in the context of a contractual relationship.

12. Modifications to these terms

Panther Forensic may modify these Terms and Conditions at any time by publishing the updated version on the Site. Changes will take effect upon publication. The last update date is indicated at the beginning of this document.

Continued use of the Site after a modification constitutes tacit acceptance of the new terms. The User is recommended to periodically review this document.

13. Suspension and termination of access

Panther Forensic reserves the right to suspend or terminate access to the Site, temporarily or permanently, to any User who violates these Terms, who engages in conduct that may harm the Site, other users, or Panther Forensic, or when required by legal provisions or competent authorities, all without prior notice or any liability.

14. Severability

If any provision of these Terms and Conditions is declared null, invalid, or unenforceable by competent authority, such declaration will not affect the validity of the remaining provisions, which will retain full force and effect.

15. Applicable legislation and jurisdiction

These Terms and Conditions are governed by the laws in force in the United Mexican States. For their interpretation, fulfillment, and execution, the parties expressly submit to the jurisdiction of the competent courts seated in Monterrey, Nuevo León, Mexico, waiving any other jurisdiction that may correspond to them by virtue of their present or future domicile or for any other cause.
